
Ontools Inc. – Terms and Conditions

Welcome to Ontools Inc., a platform connecting Canadian construction workers and employers across the country. By accessing or using our website and services, you agree to these Terms and Conditions. Please read them carefully.
1. Definitions

“Ontools Inc.” refers to the service provider and operator of the platform.

“Worker” refers to a self-employed individual offering construction services via Ontools Inc.

“Employer” refers to a company or individual seeking to hire a worker through Ontools Inc.

“Platform” refers to the Ontools website and related services.
2. General Terms

By clicking “Accept Terms and Conditions,” you agree to be legally bound by this agreement.

You must be at least 16 years old to use this service.

Ontools Inc. reserves the right to update these terms at any time. Continued use of the platform after changes means you accept the updated terms.
3. Workers – Terms of Use and Responsibilities
By registering with Ontools Inc., workers agree to the following conditions:
a) Status and Responsibilities

All workers are self-employed independent contractors. Ontools Inc. does not consider workers to be employees.

Workers are responsible for:

Showing up on time and completing tasks as agreed.

Maintaining a professional attitude and behavior on all job sites.

Reporting hours honestly and accurately.

Workers are not allowed to bypass Ontools Inc. by contacting or working directly for employers introduced through the platform. Doing so may result in immediate termination from Ontools Inc. and a financial penalty.
b) Payment and Deductions

Ontools Inc. collects payment from employers via Square (Visa/Interac) and pays workers hourly or flat rated work with direct deposit.

A small percentage of the employer’s payment is retained by Ontools Inc. as a service fee.

Taxes: Ontools Inc. remits required payroll taxes and deductions as applicable, but workers are fully responsible for filing their own income taxes with the Canada Revenue Agency (CRA) or relevant provincial agency.
c) Insurance Requirements
All workers must be insured while working on jobs provided through Ontools Inc. Insurance is mandatory to reduce liability risks for both the worker and the employer.
Two Insurance Options:

Provide Your Own Coverage
Workers may use their own valid insurance policy that includes:-
Workplace injury coverage (e.g., WSIB, private coverage)

Third-party liability
-
Medical and accident protection
Proof of insurance must be submitted to Ontools Inc. and remain active for the duration of your work on the platform.

Purchase Ontools Inc. Insurance Coverage
Workers without coverage may opt in to Ontools Inc.’s insurance plan, which includes:-
On-site injury coverage

General liability protection
-
Emergency medical care (in some provinces)

Optional tool insurance (if required)
The cost of coverage will be deducted from your payout based on hours worked. Fees are disclosed before job placement.

Important: No worker is allowed to accept job placements through Ontools Inc. without valid insurance—either personal or through Ontools Inc.’s coverage plan
4. For Employers

Employers agree to pay Ontools Inc. through Square (Visa/Interac) for all worker services based on the due date agreement.

Ontools Inc. will coordinate and compensate the worker directly.

Employers may not bypass Ontools Inc. by hiring workers directly without authorization. If this occurs, a penalty fee will apply, up to 30% of the total project cost or the equivalent of one month’s worker wages.

Employers are responsible for providing a safe working environment.

Ontools Inc. is not liable for any injuries, damages, or losses during or after the service, except when insurance coverage has been purchased by the worker.
5. Payment Terms

All payments must be made in advance or according to the agreement between Ontools Inc. and the employer.

Ontools Inc. deducts a small service fee from each worker’s hourly rate before payment is processed.

Invoices, receipts, and summaries will be available upon request.
6. Platform Use & Restrictions

Users must not attempt to misuse the platform (spam, impersonation, fraud, etc.).

Users who bypass Ontools Inc. to hire or work outside of the platform may be permanently banned.

Ontools Inc. has the right to refuse service or terminate any account at its discretion.
7. Liability & Indemnity

Ontools Inc. is not responsible for accidents, delays, injuries, or damages unless caused by gross negligence on our part.

Users agree to indemnify and hold Ontools Inc. harmless from any claims arising out of misuse, misrepresentation, or violations of these terms.
8. Termination

Ontools Inc. may suspend or terminate access to the platform at any time without notice if terms are violated.

Users may stop using the platform at any time but remain responsible for any outstanding obligations.
9. Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario, Canada.
